Article 1 — Seller identification

Article 2 — Purpose and acceptance
These Terms of Sale ("Terms") govern the entire contractual relationship between Jwayalor, trading as Borealsound ("the Seller"), and any consumer ("the Customer") placing an order on borealsound.com. Placing an order means full and unconditional acceptance of these Terms. The Seller may update these Terms at any time; the version in effect on the date of your order applies to that order.
Article 3 — Products
Products are described as accurately as possible. Borealsound Confort is a hearing aid designed to make everyday sounds easier to hear; it is not a medical device and does not diagnose, treat, or correct any hearing condition. It is not a substitute for professional medical advice. If you have concerns about your hearing, please consult a licensed healthcare professional.
Article 4 — Price
Prices are listed in Canadian dollars (CAD). Applicable Canadian sales taxes (GST/HST, and provincial sales tax where applicable) are added at checkout, based on your shipping address. The Seller may change prices at any time; the price applied is the one in effect at the time of your order.
Article 5 — Order
Your order is confirmed once you've accepted these Terms, confirmed your cart, and paid the full price. A confirmation email is sent to the Customer. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute over a prior order.
Article 6 — Payment
Payment is made online by credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, or Shop Pay. All transactions are secured (SSL encryption, PCI-DSS compliant). Payment is charged when your order is confirmed. Orders are only processed once payment has been fully received and validated.
Article 7 — Shipping
Shipping methods, timelines, and costs are described in our Shipping Policy, which forms an integral part of these Terms. All applicable import duties and taxes are prepaid, so there are no surprise fees at delivery. Risk of loss transfers to the Customer once the package is delivered.
Article 8 — Right to cancel & 45-day trial
The Customer may cancel an order before it ships, as described on our Cancel your order page. Once an order has shipped or been delivered, the Customer has 45 days from receipt to return the product for a full refund, with no reason required, as described in our Refund Policy. Return shipping costs are the Customer's responsibility, except where the product was defective on arrival or the error was the Seller's.
Article 9 — Warranty
In addition to any warranty protections available to Customers under applicable law, Borealsound offers a 12-month warranty from the date of delivery, covering manufacturing defects. This warranty does not cover: normal wear and tear, damage from misuse, lack of maintenance, drops, exposure to liquids, or unauthorized modifications. To make a warranty claim, contact us at contact@helvetisound.ch with proof of purchase and a description of the issue.
Article 10 — Liability
The Seller is not liable for any indirect damages resulting from the purchase or use of its products. In all cases, the Seller's liability is limited to the amount of the order. The Seller is not responsible for the consequences of improper use of its products, or for any individual medical incompatibilities.
Article 11 — Personal data
Personal data collected through this site is processed in accordance with our Privacy Policy and applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
Article 12 — Intellectual property
All content on this website (brand, logo, text, photos, videos, layout, code) is the exclusive property of Jwayalor. Any reproduction, in whole or in part, is strictly prohibited without prior written authorization.
Article 13 — Force majeure
The Seller cannot be held liable for failing to meet its obligations due to events beyond its reasonable control (natural disaster, pandemic, conflict, strike, failure of a supplier or carrier, etc.).
Article 14 — Governing law & jurisdiction
These Terms are governed by French law, without prejudice to any mandatory consumer-protection provisions of the law of the Customer's country of residence, including applicable Canadian and provincial consumer protection law. Any dispute relating to their interpretation or performance falls under the jurisdiction of the courts of Paris, France.
Article 15 — Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
